1.2 Reply from Asia Experience
All bookings requested will be replied by email within two (2) Malaysian business days.
2) RATES, PRICES AND VALIDITY
All rates are quoted in Malaysian Ringgit (MYR), unless otherwise specified.
2.2 Conversion Rates
Please refer to Asia Experience when making payment for the prevailing market rate.
2.3 Change of Exchange Rates
Should the Malaysian government change its foreign exchange system, Asia Experience reserves the right to change the conversion rate on section 2.20 correspondingly.
2.4 Change of Prices
All prices quoted are correct at the time of printing. In the event a service provider increases its prices to Asia Experience during the course of this contract, Asia Experience Tours reserves the right to increase the prices under this contract.
2.5 Sales and Service Tax (SST)
All prices quoted in this contract are inclusive of Malaysian Sales & Services Tax (SST).
All prices on this website are valid fro travelling from 1 March 2019 until 31 April 2020.
3) TOUR PRICE
3.1 Tour Price Includes
Prices shown are for guidance only and the actual prices will be confirmed on enquiry. Items and services included for each tour programme are listed in their own respective sections.
3.2 Tour Price Does Not Include
Flight tickets, airport tax, tips to porter, bellman, hotel maids or local guides; items of personal nature such as laundry, telephone calls, excess baggage fees and meals (unless specified in the itineraries); daily parking fees at hotel and any other items not specifically mentioned as included will be borne by the client directly.
4) TOUR INFORMATION
4.1 Tour’s Itinerary
The outline itineraries given are statements of intent rather than promises. Local conditions – weather, events, festivals or a host of other uncontrollable factors can mean a change in the tour itinerary. It is with this in mind that we reserve the right to change any of the listed services and, if necessary, even modify the itinerary itself at short notice. Where this happens, the tour leader/guide/driver will decide the best alternative.
We will not be held responsible for any closures or curtailments in circumstances beyond our control. No refunds are provided for route/programme variations.
We can cancel any tour and excursion we sell without prior notice for reasons such as maintenance, bad weather or insufficient group size. Excursions may also be subject to minimum/maximum numbers of people participating.
The tour descriptions include pictures and activities of wildlife which may be seen during the excursions, but there is no guarantee of sightings due to factors beyond our control, for example: inclement weather.
We also shall not be held responsible or liable for any loss of or damage to baggage or personal belongings during the tour.
5) HOTEL AND LUGGAGE
Rooms are assigned by the hotels and based on ROH (run of house) unless otherwise indicated. Hotel check in time is normally 1400 hours and check out is normally 1200 hours.
5.2 Luggage Allowance
As a general rule, only one piece of luggage and one carry on bag will be allowed for each client. Asia Experience reserves the right to collect payment directly from the clients for any additional costs (including transportation costs) incurred for excess luggage.
6) CANCELLATIONS, PARTIAL CANCELLATIONS, “NO SHOW” AND AMENDMENTS CHARGES
6.1 Services providers such as hotels, carriers, restaurant contractors or any other companies related to the services provided may charge cancellation, amendments and/or no show fees depending on the situation and/or circumstances.
When they levy such charges, these charges will be billed to agent through Asia Experience. Asia Experience cannot be held responsible for charges incurred due to unforeseen circumstances.
6.2 Cancellation Charges
In the event of a confirmed booking being cancelled/partially cancelled, a cancellation charge will be levied. Any cancellation received will incur the following cancellation charges: –

6.3 “No Show”
In the event a client is a “No Show”, no refund in full or in part will be given for services in the programme not utilized.
7) CANCELLATION PROCEDURES
7.1 Asia Experience must be notified in writing of any cancellation by fax or electronic mail. A notice is only considered to have been served provided that an acknowledgement and acceptance by Asia Experience is obtained.
8.1 No refund, in full or in part, will be given for services included in the programme that is not utilized.
9) FAMILY POLICY
9.1 A child under the age of 12 years old occupying the same room as his/her parents and using existing bedding is usually accommodated free of charge, except where a child rate is stated.
Child rate is 75% of adult rates (on twin sharing basis) for private package tours inclusive of meals and accommodation. The child rate is based on the child sharing a twin room with two (2) adults.
9.2 An infant is defined as an individual up to 2 years old. A child is defined as an individual above 2 years and below 12 years.
10.1 Asia Experience acts only as agents for transportation companies, hotels, car rentals and all other contractors/suppliers and finalizes all arrangements upon the expressed condition that it shall not be liable for any injury, damage, loss, accident, inadvertent errors in booking, delays generally or irregularity which may be occasioned either by reason of any defect in any vehicle, vessel or aircraft or through the acts or defaults, of any company or person engaged in conveying or accommodating passengers or in the carrying out of arrangements of the ground content, tours or otherwise in connection with its operations. To protect you and Asia Experience, we require all clients to be adequately insured against the above-mentioned liabilities.
10.2 Asia Experience will not be responsible for any additional expenses incurred by the client/s as a result of the foregoing causes over which it has no control, such as war, civil disturbance, fire,floods, unusually severe weather, acts of God or Government, broken machinery or equipment required as part of client/s’ itinerary, or unavoidable events that caused the clients’ itinerary unenforceable.
10.3 Descriptions and conditions are correct in the website. Asia Experience reserves the right to alter the itineraries and/or substitute services with or without prior notice as a result of circumstances beyond our control or if it is deemed to be in the best interests of all parties concerned.
10.4 Upon its execution to each party, this website shall become binding and enforceable according to its terms. If more than one party is obligated by any terms stated in this website, those parties shall be jointly and severally liable for the performance of those obligations.
10.5 The terms & conditions here shall be interpreted in accordance with the law of Malaysia as that law is construed and amended from time to time and any action in connection here shall be brought in the Malaysian court having jurisdiction.
10.6 In the unfortunate events where sections 9.10, 9.20 and 9.30 must jointly or separately be observed, Asia Experience shall not be held liable for any liability above and beyond the costs incurred in the provision of the services rendered.
10.7 Asia Experience reserves the right to amend any provisions in this website.
10.8 Commencement of service will signify acceptance of the above conditions and responsibilities outlined.
11.1 Any term, condition, stipulation, provision, covenant or undertaking in these General Terms and Conditions which is illegal, void, prohibited or unenforceable shall be ineffective only to the extent of such illegality, voidness, prohibition or unenforced ability without invalidating the whole such term, condition, stipulation, provision, covenant or undertaking or affecting the validity or enforce ability thereof and any such illegality, voidness, prohibition or unenforced ability shall not invalidate or render illegal, void or unenforceable any other term, condition, stipulation, provision, covenant or undertaking herein contains.
